1. Introduction
1.1. These Terms and Conditions ("Terms") govern the provision of real estate photography and marketing services ("Services") by Aspects Imaging Group, LLC, a company registered under the laws of Shasta County.
1.2. By engaging the Company for Services, you ("Client") agree to be bound by these Terms in full. If you disagree with any part of these Terms, please refrain from using our Services.
2. Services
2.1. The Company shall provide the Client with professional real estate photography and marketing services as agreed upon in writing or as per the quotation provided.
2.2. The scope of the Services, including but not limited to the number of photographs, type of marketing materials, and delivery timeline, shall be agreed upon between the Client and the Company prior to the commencement of work.
2.3. Any additional services requested by the Client that are not included in the initial agreement may be subject to additional charges and will be agreed upon in writing.
3. Fees and Payment
3.1. The Client agrees to pay the Company the agreed-upon fees for the Services as outlined in the quotation or contract.
3.2. Payment terms shall be as specified in the invoice provided by the Company. Unless otherwise agreed upon, payment is due within [number of days] days from the date of invoice.
3.3. Failure to make timely payments may result in the suspension of Services until payment is received in full.
3.4. All fees are exclusive of any applicable taxes, which shall be the responsibility of the Client.
4. Intellectual Property
4.1. The Company retains all intellectual property rights, including but not limited to copyrights, in the photographs and marketing materials produced as part of the Services.
4.2. Upon full payment of the agreed-upon fees, the Client is granted a non-exclusive, non-transferable license to use the photographs and marketing materials for the purpose of marketing the relevant real estate property.
4.3. The Client agrees not to modify, reproduce, or distribute the photographs and marketing materials without the prior written consent of the Company.
5. Client Obligations
5.1. The Client shall provide access to the property to be photographed at the agreed-upon date and time.
5.2. The Client shall ensure that the property is clean, decluttered, and staged appropriately for photography.
5.3. The Client shall provide any necessary permissions or authorizations required for the Company to carry out the Services, including but not limited to access to gated communities or private properties.
6. Confidentiality
6.1. Both parties agree to treat any confidential information shared during the provision of Services as confidential and shall not disclose such information to third parties without the other party's consent.
7. Limitation of Liability
7.1. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the provision of Services, including but not limited to loss of profits, revenue, or data.
7.2. The total liability of the Company arising out of or in connection with the provision of Services shall not exceed the total fees paid by the Client to the Company.
8. Termination
8.1. Either party may terminate the agreement for Services upon written notice if the other party breaches any material provision of these Terms and fails to remedy such breach within [number of days] days of receiving written notice.
9. Governing Law
9.1. These Terms shall be governed by and construed in accordance with the laws of Shasta County. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Shasta County.
10. Amendments
10.1. The Company reserves the right to amend these Terms at any time. Any amendments shall be effective immediately upon posting on the Company's website or other applicable channels. It is the Client's responsibility to review these Terms periodically for changes.

2. Returns and Refunds
2.1. Due to the nature of the Services provided, the Company does not offer returns on completed photography or marketing materials.
2.2. If the Client is unsatisfied with the quality of the Services provided, they may request revisions within a reasonable timeframe as agreed upon between the Client and the Company.
2.3. Refunds may be considered on a case-by-case basis if the Company fails to deliver the Services as agreed upon or if there are extenuating circumstances that warrant a refund. Any such requests must be submitted in writing to the Company within [3] days of receiving the completed Services.
3. Eligibility for Refunds
3.1. To be eligible for a refund, the Client must provide clear evidence demonstrating that the Company has failed to meet its obligations as outlined in the agreement or that there are valid reasons for the request.
3.2. Refunds will not be issued for reasons beyond the Company's control, including but not limited to changes in the Client's preferences or circumstances relating to the sale of the property.
4. Refund Process
4.1. Upon receipt of a refund request, the Company will review the request and determine its eligibility based on the criteria outlined in this Policy.
4.2. If the refund request is approved, the Company will issue a refund to the Client within [3] days using the same method of payment used for the initial transaction.
4.3. The Client acknowledges that it may take additional time for the refund to be reflected in their account depending on the policies of their financial institution.
5. Exceptions
5.1. This Policy does not apply to any additional services or products purchased from third-party vendors or suppliers in connection with the Services provided by the Company. Returns and refunds for such items will be subject to the policies of the respective vendors or suppliers.
